vivid/stasis Derivative Works Policy
At Hajimeli, we understand that a lot of people are interested in creating fan content for things they enjoy, so we've written up these guidelines surrounding derivative works relating to "vivid/stasis".
These are subject to change at any given time.
Any fan content must include attribution to vivid/stasis by Hajimeli / Team Vividstasis, published by SKY HOUR WORKS, and it must also include a clear explanation that the content is not officially endorsed or owned by Hajimeli or SKY HOUR WORKS.
Do's and Don'ts
The following content is allowed by this policy.
- Fan-made artwork (fanart), so long as it is SFW (not 18+)
- Fan-made writing (fanfiction), so long as it is SFW (not 18+)
- Fan-made music (in the case of referencing songs used in the vivid/stasis game)
The following content is prohibited by this policy.
- Fan-made content intended to replicate or replace any aspect of the vivid/stasis gameplay experience (i.e. gameplay simulator or story simulator)
- NSFW content or content involving any kind of nudity or sexually explicit depictions
- Content that infringes on the derivative works guidelines / terms of service of other products and properties
- Content that promotes hate speech or discrimination of any kind, including but not limited to racism, transphobia, homophobia, sexism, etc.
- Content that makes use of "Web3" technology (i.e. cryptocurrency or NFT)
- Content that makes use of generative AI / GenAI / GPT
Fan Merchandising
Fan merchandise related to the characters/story/gameplay of vivid/stasis is not strictly prohibited, but there are some guidelines that must be followed.
- You may not sell any fan merchandise relating to vivid/stasis on any online/digital storefronts
- Physical locations such as art booths at conventions are permitted, as long as you run it by Cheryl first. You can contact me at starspirecloverfield@gmail.com by email.
- Any fan merchandise that is being sold at any cost is not permitted to contain any materials from the vivid/stasis game itself, including but not limited to direct assets, screenshots, audio, storepage graphics, etc.
Community Rhythm Game Content
Regarding the usage of vivid/stasis original songs in other community rhythm games (i.e. osu!, Quaver), there are some guidelines that must be adhered to.
The following process must be followed before fanmade content in other games can be made.
1. Check the Community Permission List. This is a spreadsheet that details which songs have granted permission from Hajimeli to be used in other games. A number of songs have been disallowed due to personal importance to the story of vivid/stasis.
2. Get the artist's permission. Even if the song you want to chart is listed as Allowed on the above sheet, you still need individual artist permission. Look for a way to contact the artist, or, if the game you're charting for has a whitelist system like Rhythm Doctor or A Dance of Fire and Ice, check that the artist is not listed as not being allowed.
3. If the game you're intending to chart for violates another property's terms of service (i.e. unlicensed modded content for a game), you are not allowed to chart the song for it even if you have the above two permissions.
There may be some gray area cases that aren't covered here; if you have a question, please leave a comment on the linked spreadsheet.
Modding and Datamining
There have been some instances in the past of people asking about datamining and modding the game, so this section serves to clearly illustrate our stance on the matter.
Datamining the game content is not allowed while the game is still in development. Discussion of datamined content or admittal to having datamined the game in any Hajimeli space (the Discord server, for example) will result in your removal from the space.
Modding the game is not allowed and likely will not be. We understand that some players want something akin to a custom chart system to chart other songs in the game, and this is something we'd like to implement before the game is fully complete, but will need to give a lot of thought to.
These rules only apply to vivid/stasis. Other Hajimeli projects may not share the same derivative works policy.
